We respect your privacy and are determined to protect your personal data. The purpose of this privacy notice is to inform you as to how we look after your personal data when you visit our website (regardless of where you visit it from). What is the purpose of this privacy notice?

This privacy notice aims to give you information on how we collect and process your personal data through your use of this website, including any data you may provide through this website when you SIGN UP TO OUR NEWSLETTER, SUBSCRIBE TO OUR PODCAST or PURCHASE A PRODUCT OR SERVICE

This website is not intended for children and we do not knowingly collect data relating to children.

You must read this privacy notice together with any other privacy notice we may provide on specific occasions when we are collecting or processing personal data about you so that you are fully aware of how and why we are using your data. This privacy notice supplements the other notices and is not intended to override them.

Third-party links outside of our control

This website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. We do not control these third-party websites and are not responsible for their privacy statements. 

When you leave our website, we encourage you to read the privacy notice of every website you visit.

2. The personal data we collect about you

Personal data, or personal information means any information about an individual from which that person can be identified. You can find out more about personal data from the Information Commissioners Office.

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together follows:

  • Identity Data includes email address, IP address and location.
 

We do not collect any Special Categories of Personal Data about you (this includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data). Nor do we collect any information about criminal convictions and offences.

If you fail to provide personal data 

Where we need to collect your personal data by law, or under the terms of a contract we have with you and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

3. How we collect your personal data

We use different methods to collect data from and about you including: 

  • Directly. You may give us your identity and contact details by filling in forms or by corresponding with us by post, phone, email or otherwise. This includes personal data you provide when you:
    • Subscribe to our events or publications including our newsletters or podcast
    • Request marketing materials to be sent to you
    • Sign up to use our services
    • Ongoing use of the Profyle Card SaaS platform
 

4. How we use your personal data

We will only use your personal data when the law allows us to. Most commonly, we will use your personal data in the following circumstances:

  • Performance of Contract this means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.
  • Legitimate Interest this means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). You can obtain further information about how we assess our legitimate interests against any potential impact on you in respect of specific activities by referring to the “Our Services” section of our website or contacting us directly.
  • Comply with a legal or regulatory obligation this means processing your personal data where it is necessary for compliance with a legal or regulatory obligation that we are subject to.
 

Generally, we do not rely on consent as a legal basis for processing your personal data other than in relation to sending third party direct marketing communications to you via email or text message. you have the right to withdraw consent to marketing at any time by using the unsubscribe link included in any marketing communications or emailing the DPO at dpo@profylecard.com.

Any data entered into your Profyle Card account within the Profyle Card SaaS platform (if you have purchased a Profyle Card product from us) is held securely and will not be used for any other purposes other than for the reasons above or to display your profile when accessed by your unique profile link.

Purposes for which we will use your personal data

We have set out below, a description of all the ways we plan to use your personal data:

  • Registering and operating an account with you
  • Managing our relationship with you
  • Administer and protect our business
  • Use data to improve our website and marketing materials
  • To deliver marketing materials to you including newsletters and podcast content
  • Recommending products or services
  • Improving our products or services
  • Identifying prospective customers
  • To monitor our communications with you for training purposes, crime prevention, to improve the quality of our customer service and to defend legal claims

Cookies

You can set your browser to refuse all or some browser cookies, or to alert you when websites set or access cookies. If you disable or refuse cookies, please note that some parts of this website may become inaccessible or not function properly. Change of purpose

We will only use your personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so.

Please note that we may process your personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.

5. Who we share your personal data with

We may have to share your personal data with the parties set out below for the purposes set out in the table in Section 4 above.

  • External Third Parties Service including consultants providing Marketing services.
  • Third parties to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.
 

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

Third-Party Processor:

Our carefully selected partners and service providers may process personal information about you on our behalf as described below:

Digital Marketing and other Service Providers

We periodically appoint digital marketing agents to conduct marketing activity on our behalf, such activity may result in the compliant processing of personal information.  Our appointed data processors include:

(i) Lemlist, a third-party service provided by lempire SAS (a company registered under France law number 823 475 082), to track and record visitor interactions on our website. This includes collecting data such as mouse movements, clicks, page views, scrolling behavior, and form interactions for the purposes of lead generation, sales optimisation, and improving user experience on our site.

When you visit our website, Lemlist may collect and process your personal data as described above. We act as the data controller for this processing, while Lemlist serves as our data processor under the General Data Protection Regulation (GDPR). The data collected through Lemlist is stored securely and used solely for the purposes outlined in this privacy policy.

You have the right to opt-out of this tracking, access your personal data, request rectification of inaccurate information, or request deletion of your data. If you wish to exercise any of these rights or have questions about how your data is processed through Lemlist, you can contact us directly or reach out to Lemlist’s Data Protection Officer at privacy@lemlist.com.

(ii) Google Analytics, a web analytics service provided by Google LLC (“Google”), to help analyze how visitors use our website. Google Analytics acts as a data processor under GDPR, collecting and processing data on our behalf pursuant to our instructions, while we remain the data controller.

Google Analytics collects information such as your IP address, browser and device information, pages visited, time spent on pages, referring websites, geographic location, and user interactions with our website. GA4 uses first-party cookies including _ga (which distinguishes users and expires after two years) and _ga<container-id> (which distinguishes session state and expires after two years).

We use this information to analyse website performance, understand user behaviour, improve our content and user experience, and make informed decisions about our services and products.

The data collected through Google Analytics is shared with Google as a third-party processor. Google processes this data according to their privacy policy and our instructions as outlined in Google’s Data Processing Terms.

You have the right to opt-out of Google Analytics tracking through browser settings, by installing Google’s official browser add-on, or through opt-out mechanisms on our website. Under GDPR, you also have the right to access, rectify, restrict processing, or request deletion of your personal data.

In accordance with GDPR requirements, we obtain your explicit consent before Google Analytics cookies are placed on your device. You can withdraw this consent at any time through our cookie preference center.

Google Analytics data is retained according to our configured retention settings and in compliance with applicable data protection laws.

(iii) We use the LinkedIn Insight Tag, a lightweight JavaScript code provided by LinkedIn Corporation, on our website to enable campaign reporting, conversion tracking, and website retargeting capabilities. LinkedIn acts as a data processor for this service, while we remain the data controller under GDPR.

The LinkedIn Insight Tag collects data regarding your visits to our website, including the URL, referrer, IP address, device and browser characteristics (User Agent), and timestamp. When you visit our website, the tag creates a unique LinkedIn browser cookie on your device to track your interactions with our site.

IP addresses are truncated or hashed when used for reaching members across devices, and members’ direct identifiers are removed within seven days to make the data pseudonymous. This remaining pseudonymized data is then deleted within 180 days.

We use this information for remarketing campaigns, conversion tracking, audience insights, and to better understand the professional demographics of our website visitors. This helps us deliver more relevant content and advertisements to LinkedIn users who have previously visited our site.

You have the right to withdraw your consent at any time and request deletion of your personal data. LinkedIn members can manage their advertising preferences and data usage through their LinkedIn privacy settings. You can also opt-out of LinkedIn’s advertising cookies through your browser settings or LinkedIn’s opt-out mechanisms.

Under GDPR, we obtain informed and explicit consent from users before tracking them for remarketing purposes. LinkedIn provides GDPR compliance features that allow us to display consent messages to users before data collection begins.

inkedIn Corporation serves as a joint controller for certain data processing activities. As the website owner, we are responsible for ensuring we have a legal basis and right to provide LinkedIn any personal data for advertising purposes and for GDPR compliance regarding any personal data we may gather in response to advertisements.

(iv) We use the Meta Pixel (formerly Facebook Pixel), a piece of JavaScript code provided by Meta Platforms, Inc. (formerly Facebook), on our website to track visitor behavior and measure the effectiveness of our advertising campaigns. Meta acts as a data processor for this service, while we remain the data controller under GDPR.

The Meta Pixel collects various types of data about your interactions with our website, including:

  • HTTP header information (IP address, web browser details, operating system, referrer URL, page views, and session information)
  • Pixel-specific data (unique pixel ID and Facebook cookies)
  • Website interaction data (pages visited, buttons clicked, button labels, time spent on pages)
  • Form field names (such as “email,” “address,” “phone number”) and, if Advanced Matching is enabled, form field values
  • Device and browser characteristics, timestamp information
  • Shopping cart contents and purchase information (when applicable)

The data collected is shared with Meta Platforms, Inc., which may process this information in the United States and other countries. Meta uses this data to help us measure ad performance, create custom audiences for remarketing, and optimize our advertising campaigns across Facebook, Instagram, and the Meta Audience Network.

Meta may connect the data collected through our pixel to your Facebook or Instagram profile, even if you’re not currently logged in, through various matching techniques including cookies and Advanced Matching parameters.

We use this information for conversion tracking, remarketing campaigns, audience insights, advertising optimization, and to measure the effectiveness of our Facebook and Instagram advertising campaigns. This helps us deliver more relevant advertisements and improve our marketing efforts.

Data collected through the Meta Pixel may be transferred to the United States and other countries where Meta operates. We rely on Meta’s compliance with applicable data transfer mechanisms, including Standard Contractual Clauses and the EU-U.S. Data Privacy Framework.

Under GDPR, you have the right to:

  • Withdraw consent at any time
  • Access your personal data
  • Request rectification or deletion of your data
  • Object to processing for direct marketing purposes
  • View and manage “Off-Facebook Activity” in your Facebook privacy settings (if you have a Facebook account)

We obtain your explicit consent before the Meta Pixel becomes active and begins collecting your data. You can withdraw this consent at any time through by adjusting your browser settings to block third-party cookies.

We implement appropriate consent mechanisms that block tracking until you provide permission, practice data minimisation by tracking only essential events, and maintain transparency about our use of the Meta Pixel and data transfers to the United States.

(v) Pipedrive Web Visitors, a website visitor tracking feature provided by Pipedrive Inc., powered by Leadfeeder’s infrastructure, to identify which organisations visit our website and analyse their browsing behavior. Pipedrive acts as a data processor for this service, while we remain the data controller under GDPR.

The Pipedrive Web Visitors tracking script collects the following data about your website visits:

  • Behavioural data including pages viewed, visitor sources, and time spent on each page
  • IP addresses to detect company identification and geographic location through reverse IP address lookup
  • Complete browsing history showing which pages and content areas you engage with
  • Referrer information showing how you found our website (search engines, campaigns, direct visits)
  • Session data including visit timestamps and duration
  • Device and browser characteristics contained in HTTP headers

We use reverse DNS lookup to translate IP address information into company names and locations. Only visits from identifiable business organisations will appear in our tracking system. Visitors from residential IP addresses (home wifi, mobile networks) are automatically filtered out and will not be tracked or recorded.

All visitor data is collected through Leadfeeder’s AWS infrastructure, where it is encrypted both in transit and at rest. The tracking system automatically filters out Internet Service Providers (ISPs), web crawlers, and other irrelevant traffic to ensure we only process data from legitimate business prospects.

We use this information for:

  • Lead generation and business development activities
  • Understanding which content and pages are most valuable to potential customers
  • Improving our website user experience and content strategy
  • Following up with organisations that have shown interest in our services
  • Marketing campaign optimisation and attribution analysis
  • Account-based marketing and sales outreach

Visitors are automatically ranked based on their web activity level, allowing us to prioritise follow-up activities with the most engaged prospects. We may use additional tools like Pipedrive’s Prospector to identify specific contact persons within visiting organisations.

Website visitor data is retained for as long as you maintain an active relationship with us or until you request deletion. When the Web Visitors tracking script is uninstalled from our website, all associated visitor data will be deleted to comply with GDPR requirements.

Under GDPR, you have the right to:

  • Request access to your personal data
  • Request rectification of inaccurate information
  • Request deletion of your data
  • Withdraw consent at any time
  • Object to processing for direct marketing purposes

We process this data based on our legitimate business interests in identifying potential customers and improving our sales and marketing efforts. We ensure this processing is balanced against your privacy rights and interests.

6. International Transfer

We do not transfer your personal data outside the EEA.

7. Data Security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal data to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

8. Data retention

We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

9. Your legal rights

Unless subject to an exemption under the data protection laws, you have the following rights with respect to your personal data: 

  • The right to request a copy of the personal data which we hold about you;
  • The right to request that we correct any personal data if it is found to be inaccurate or out of date;
  • The right to request your personal data is erased where it is no longer necessary to retain such data;
  • The right to withdraw your consent to the processing at any time, where consent was the lawful basis for processing your data; 
  • The right to request that we provide you with your personal data and where possible, to transmit that data directly to another data controller, (known as the right to data portability), where applicable 9i.e. where our processing is based on consent or is necessary for the performance of our contract with you or where we process your data by automated means); 
  • The right, where there is a dispute in relation to the accuracy or processing of your personal data, to request a restriction is placed on further processing;
  • The right to object to our processing of personal data, where applicable i.e. where processing is based on our legitimate interests (or in performance of a task in the public interest/exercise of official authority); direct marketing or processing for the purposes of scientific/historical research and statistics).

Other than account-based emails that we are legally required to send you, any other email communication will always include a link to unsubscribe from further emails.

No fee required – with some exceptions

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable admin fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we may refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within one month. Occasionally it may take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

Please keep us informed if your personal data changes during your relationship with us. It is important that the personal data we hold about you is accurate and current.
